These Terms of Service (“Terms”) govern your access to and use of Guardian Maintenance’s services, website, communications, and equipment rentals. By requesting services, submitting information, or communicating with Guardian Maintenance (“Guardian,” “we,” “our,” or “us”), you agree to be bound by these Terms.
If you do not agree to these Terms, do not use our services.
1. Services Provided
Guardian Maintenance provides property maintenance, repair services, emergency response support, and equipment rentals, including but not limited to portable air-conditioning units, heaters, dehumidifiers, fans, and related equipment (“Services”).
Services may be performed by Guardian Maintenance employees or independent contractors at Guardian’s discretion.
2. Independent Service Provider
Guardian Maintenance operates as an independent maintenance and vendor company. Guardian is not:
• A property owner
• A property manager
• An insurer
• A warranty company
• A utility provider
Guardian Maintenance is not responsible for landlord-tenant disputes, lease enforcement, habitability determinations, or property ownership obligations.
3. Service Requests & Authorization
By submitting a service request, you authorize Guardian Maintenance to:
• Enter the property as permitted
• Perform requested or necessary work
• Use subcontractors when required
• Communicate via phone, email, or SMS
Emergency services are handled on a best-effort basis and do not guarantee immediate resolution.
4. Estimates & Scope of Work
• Estimates are based on initial information and may change after inspection
• Additional repairs may require approval
• Guardian may pause work if scope changes materially
• Hidden conditions, code requirements, or safety issues may affect pricing
Guardian Maintenance is not responsible for pre-existing conditions or concealed defects.
5. Equipment Rentals
A. Ownership & Use
• All rental equipment remains the property of Guardian Maintenance
• Equipment must be used only as intended
• Equipment may not be modified, relocated, or sub-rented
B. Responsibility
Customers are responsible for:
• Proper use and care
• Damage, loss, or theft
• Electrical compatibility and safe placement
C. Charges
• Rental fees are billed daily or weekly
• Late returns may incur additional charges
• Damaged or missing equipment may be billed at replacement value
6. Payment Terms
• Payment terms are disclosed prior to service
• Invoices are due per stated terms
• Late or unpaid balances may result in service suspension
• Guardian Maintenance may pursue collection of unpaid balances
Guardian is not obligated to continue service for accounts in default.
7. SMS Messaging Terms (A2P Required)
By providing your mobile number and opting in, you consent to receive SMS messages from Guardian Maintenance related to services, scheduling, emergency notifications, and account updates.

• Reply HELP for assistance
Consent to receive SMS messages is not a condition of purchase.
8. Access & Safety
• Customer must provide safe and legal access to the property
• Guardian may refuse or stop work if unsafe conditions exist
• Guardian is not responsible for delays caused by denied access, pets, utilities, or site conditions
9. Limitation of Liability
To the fullest extent permitted by law:
• Guardian Maintenance is not liable for indirect, incidental, or consequential damages
• Guardian is not responsible for utility outages, weather delays, or third-party failures
• Liability is limited to the amount paid for the specific service rendered
10. Indemnification
You agree to indemnify and hold harmless Guardian Maintenance, its owners, employees, and contractors from claims, damages, losses, or expenses arising from:
• Misuse of equipment
• Failure to disclose property conditions
• Violation of these Terms
• Third-party claims related to service access or authorization
11. Warranty Disclaimer
Services are provided “as-is” and “as available.” Guardian Maintenance makes no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
12. Force Majeure
Guardian Maintenance is not liable for delays or failures caused by events beyond reasonable control, including but not limited to:
• Weather events
• Natural disasters
• Utility outages
• Government actions
• Supply chain disruptions
13. Termination of Services
Guardian Maintenance reserves the right to:
• Refuse service
• Suspend ongoing work
• Terminate service relationships
for non-payment, unsafe conditions, abusive behavior, or violation of these Terms.
14. Governing Law
These Terms are governed by the laws of the state in which services are performed, without regard to conflict-of-law principles.
15. Modifications
Guardian Maintenance may update these Terms at any time. Continued use of services after updates constitutes acceptance of the revised Terms.
